PRONOUNCEMENT ABOUT THE SITUATION OF SHUAR INDIGENOUS PEOPLE OF ECUADOR

The Coordinator of Indigenous Organizations of the Amazon Basin - COICA, integrated by the indigenous organizations of the 9 countries that cover the majestic Amazon jungle, Peru (AIDESEP), Ecuador (CONFENIAE), Brazil (COIAB), Colombia (OPIAC), Guyana French (FOAG), Guyana (APA), Suriname (OIS), Bolivia (CIDOB) and Venezuela (ORPIA); call to  Ecuadorian government, International Human Rights Organizations, International Labor Organization, United Nations Special Rapporteur of the Rights of Indigenous Peoples, Inter-American Commission on Human Rights, , National and international community and the mass media.

Against the situation about the evit of Shuar families from the Nankints community of their ancestral territories, the declaration of Emergency in the province of Morona Santiago and the militarization of the Nankints community and its surroundings, we express:

We demand to the Ecuadorian government the IMMEDIATE demilitarization of the Nankints community and the lifting of the Emergency of the province of Morona Santiago. In accordance with article No. 57, numeral 20 of the Political Constitution of Ecuador, which states: "Indigenous communes, communities, peoples and nationalities shall be recognized and guaranteed in accordance with the Constitution and with covenants, covenants, declarations and Other international human rights instruments, the following collective rights: 20. The limitation of military activities in their territories, in accordance with the law. "

We hold the Ecuadorian government accountable for any incident that may arise within the Nankints community if the Emergency is not lifted and the territory of the Nankints community is not demilitarized.

We make an urgent appeal to the parties involved in the conflict to embark on a process of dialogue aimed at finding a peaceful, effective and immediate solution. And offer us our organizational space to start with the processes of dialogue, negotiation and consensus.

We denounce before the International Organizations of promotion and defense of human and of indigenous peoples rights the breach of the process of prior consultation and free, prior and informed consent. In accordance with the provisions of the United Nations Declaration of the Rights of Indigenous Peoples article no. 19 which states: "States shall consult and cooperate in good faith with the indigenous peoples concerned through their representative institutions before adopting and implementing legislative or administrative measures affecting them in order to obtain their free, prior and informed consent" ; Convention no. 169 of the International Labor Organization article no. 6, which states: "In applying the provisions of this Convention, Governments shall: (a) consult the peoples concerned, through appropriate procedures and in particular through their representative institutions, whenever legislative or administrative measures are envisaged Capable of affecting them directly ... "; And the Political Constitution of Ecuador in article no. 57, numeral 7, which states: "... 7. Prior consultation, free and informed, within a reasonable time, of plans and programs for prospecting, exploitation and commercialization of non-renewable resources that are on their lands and that may affect them environmentally Or culturally; Participate in the benefits that these projects report and receive compensation for the social, cultural and environmental damages caused to them. The consultation to be carried out by the competent authorities shall be obligatory and timely. If the consent of the consulted community is not obtained, proceed according to the Constitution and the law ... ".

COICA and its bases organizations support all the actions that CONFENIAE and FICSH undertake to guarantee the territorial security of the Shuar people of the Nankints community. As well as all initiatives for a peaceful and effective solution.

COICA as an international indigenous organization will support all legal actions undertaken by the Shuar people in order to ensure the wellbeing and survival of peoples.

COICA will be vigilant in the face of these events and reserves the right to go before international bodies within the framework of ILO Convention 169 and the United Nations Declaration on the Rights of Indigenous Peoples to protect the lives of Indigenous Peoples.
